The following terms and conditions of contract apply from the date of this confirmation letter. Written confirmation of a booking by the client implies acceptance of these terms and conditions. In these terms and conditions, the expression ' the hotel' means the Miskin Manor Hotel and Health Club, and the expression 'the client' means the person, firm or company booking the function at the hotel.

  1. Payment
    Payment shall be by cash, cheque, bankers draft or such credit cards as are accepted by the hotel. Credit facilities are
    available subject to satisfactory references and an application form is available on request. Facilities for payment by
    credit or debit card are available.

    The hotel reserves the right to require payment of a non-refundable deposit at any time prior to the holding of the
    function, conference or wedding - the amount of which will be determined by the hotel. Should the client fail to pay
    such deposit within 14 days of being requested to do so, the hotel may treat the booking as having been cancelled by
    the client. Payment or credit terms must be agreed with the hotel at least 28 days prior to the commencement of the
    function, conference or wedding.

    Where credit arrangements have been made, accounts are payable in full within 14 days of the date of the invoice.
    Where payment is not made within this time, the hotel reserves the right to charge interest on the amount outstanding
    at 5% above the base lending rate for the time being of Barclays Bank plc.

    When neither payment nor credit arrangements have been made, the hotel reserves the right to cancel the booking
    unless full pre-payment has been made at least 14 days prior to the commencement of the function, conference or
    wedding.

    The hotel may, at its discretion, increase the estimated price of the conference, function or wedding at any time in the
    event of any increase in costs payable by the hotel.

    All sums pursuant to this agreement are due for immediate payment on presentation of an invoice. Any query
    concerning the agreement or the changes made shall not affect the client's obligation to pay all outstanding balances
    immediately. The hotel reserves the right to charge interest at the rate of 2% for each 28 day period or part thereof, on
    any outstanding balance.

    VAT is included on all payments, including deposits.

  2. Cancellations
    If the client cancels a conference, function or wedding, the following charges will be due in addition to the loss of the
    initial deposit. In each case the percentage charge applies to the estimated total account for the event:

    • Functions and Weddings
      For cancellations between 26 weeks and 12 weeks prior to the start date - 50%
      For cancellations between 12 weeks and 4 weeks prior to the start date - 80%
      For cancellations less than 4 weeks prior to the start date - 100%

    • Residential and Non Residential Conferences
      For cancellations between 26 weeks and 8 weeks prior to the start date - 20%
      For cancellations between 8 weeks and 4 weeks prior to the start date - 80%
      For cancellations less than 4 weeks prior to the start date -100%

    The hotel will endeavour to re-let the allocated space and any related bedrooms, and a reduction of the cancellation
    charge will be made is the hotel is successful. The hotel will off-set any deposits or any other monies paid to it by the
    client against any outstanding sum.

  3. Non Arrival Charges
    Bedrooms reserved in conjunction with a conference, function or wedding, and subsequently cancelled or not taken
    up, will be subject to the cancellation policy set out in paragraph 2.

  4. Licensing and Statutory Regulations
    The hotel, conferences and functions within it, are subject to statutory regulations including those relating to fire
    precautions and entertainment. The regulations must be strictly observed and a copy is available from the hotel. The
    provisions of the Licensing Act 1964 as amended must also be observed.

  5. Third Party Insurance
    The hotel accepts NO RESPONSIBILITY for the death, bodily injury or disease arising from any cause whether to:

    • Persons visiting the hotel and/or the allocated rooms on behalf of, or at the request of, the client,
      whether such death, injury or disease occurs within the allocated rooms or in any other part of the
      hotel.

    • Persons employed by the client during the period of hire, whether such death, injury or disease occurs
      within the allocated rooms or in any other part of the hotel.
      Except for legal liability arising due to the negligence of the hotel, its employees, servants,
      representatives or agents.
  6. Cloaks and Personal Property
    The hotel accepts no responsibility for loss or damage to the property of clients or guests. Cloakrooms facilities are
    provided for the convenience of clients and guests, but any property deposited in it is strictly at owner's risk, except
    for legal liability arising due to negligence of the hotel, its employees, servants, representatives or agents.

  7. Equipment and Storage
    The hotel will assist clients, at its discretion, with storage of equipment etc. The hotel does not accept any liability for
    loss or damage to any item of equipment, stock or the like.

  8. Professional Bodies
    The hotel reserves the right to object to the employment by clients and guests of any photography, toastmasters, band,
    musician or other persons in connection with any function, conference or wedding, and will, without obligation, be
    pleased to give customers and guests the benefit of their advice or recommendations in this connection.

  9. Corkage
    No wines, spirits or beers may be brought into the allocated rooms by the client or guest for consumption on the
    premises. The hotel reserves the right to make a charge if this is found to have taken place.

  10. Finishing Times
    Functions, conferences and weddings are required to finish at the times agreed when the booking was made.
    Extensions to this time may be chargeable and are at the sole discretion of the hotel and are, in any event, subject to
    the Statutory Licensing Regulations referred to in clause 4.

  11. Re-Confirmation
    Weddings The client shall meet with the hotel approximately 8 weeks prior to discuss the menu and drinks and to
    give the anticipated number of guests attending. The final number should be advised no later than 2 weeks prior to
    the wedding, when full payment is required. No changes to any arrangements can be accepted after this date.

    All other Functions The client shall notify the hotel not less than 10 days prior to the function, conference or banquet,
    the anticipated number of guests attending and to supply the details of any pre-ordered drinks and food. The final
    numbers must be notified to the hotel no less than 48 hours prior to the function.
    The size of the function space allocated is based on the expected number of attendees, and should this figure be less
    than 90% of the number first booked, the hotel reserves the right to change the allocated function space or to charge a
    surcharge.
    The amount payable by the client shall be calculated on this final number or the number actually attending,
    whichever is the greater.
    The hotel reserves the right to decline to cater for guests in excess of the finally confirmed numbers, and although it
    will make its best endeavours to serve them, it will not be liable for any failure to provide such additional
    accommodation or service.

  12. General Liability
    A: The hotel shall not be liable for any failure to provide the contracted services in the following circumstances:

    1. Industrial action by the hotel's employees
    2. Industrial action by the staff of a major supplier
    3. Fire, Lightning, Aircraft Impact, Explosion, Riot or Civil Commotion, Malicious Damage,
      Storm, Tempest, Burst Pipes, Earthquake and Impact.
    4. Postal bookings which do not reach the hotel
    5. Breakdown of plant, or any other failure to supply the hotel with Gas, Electricity, Water
      services

      Without prejudice to the foregoing and without inferring any liability against them the hotel undertakes all
      possible action to alleviate any such inconvenience

    B: This contract shall not be assignable

    C: This contract shall be governed by, and construed in all aspects, in accordance with the laws of England

  13. Damage
    The client shall be responsible for any damage caused to the allocated space or the furnishings, utensils and
    equipment therin, by act, default or neglect of the client, including by any sub-contractor or guests of the client and
    shall pay to the hotel on demand the amount required to make good or remedy any such damage.

  14. The hotel may, at its discretion, cancel the function and return the client's deposit if the hotel considers the
    function will adversely affect the smooth operation of the hotel or disturb the guests.

  15. Advertising
    Clients wishing to print details of the hotel or its telephone number in any publication or advertisement must seek
    permission from the hotel prior to doing so.

  16. Hotel Proprietors Act 1956
    This agreement does not affect any rights which the client may have under the Hotel Proprietors Act 1956.

  17. Should the client, or clients' contractor, require the hotel to supply mechanical and/or electrical equipment for
    use at a function, conference or wedding, then the client hereby indemnifies the hotel against any claims resulting
    from death or injury to any individuals appointed by the client or clients' contractor, to use the said equipment
    unless such death or injury is caused by the negligence or wilful act or wilful omission of the hotel or its employees.

  18. Insurance
    No responsibility whatsoever is accepted in respect of theft, injury or disease, neither to delegates nor visitors, for loss
    or damage to property of any kind unless arising as a legal liability for negligence by the hotel or employees, or
    representatives or agents, Clients should arrange their own insurance for the period of the conference, function or
    wedding. Special schemes are available.
